1. Acceptance of Terms
By accessing or using Scratch IQ ("the Service"), operated at scratchiq.io, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.
We may update these Terms from time to time. We will notify you via the email address associated with your account at least thirty (30) days before any material changes take effect. If you do not agree to the revised terms, you may cancel your account before the changes become effective. Continued use after the effective date constitutes acceptance of the revised terms.
2. Description of Service
Scratch IQ is an analytics dashboard that calculates the Expected Value (EV) of state lottery scratch-off games using publicly available remaining prize data. The Service provides data visualization, historical tracking, and analytical tools to help users make informed decisions. Scratch IQ is not a gambling platform and does not sell, distribute, or facilitate the purchase of lottery tickets.
3. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary.
You must be at least 18 years old and meet the minimum legal age for lottery participation in your jurisdiction to create an account and use the Service. By creating an account, you represent and warrant that you meet these age requirements. If we become aware that a user is under the applicable minimum age, we will terminate their account and delete their personal data.
4. Subscriptions & Billing
Scratch IQ offers both free and paid subscription tiers. Paid subscriptions ("Pro") are billed on a recurring monthly or annual basis through Stripe, our third-party payment processor. By subscribing to a paid plan, you authorize Scratch IQ to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through the billing portal. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds are provided for partial billing periods.
If your payment method fails or a charge is declined, we may suspend access to paid features until a valid payment method is provided. If payment cannot be collected within fourteen (14) days, your subscription may be automatically cancelled. If you initiate a chargeback or payment dispute with your bank or payment provider, we reserve the right to suspend your account pending resolution.
Prices are subject to change. We will notify you via email at least thirty (30) days before any price increase takes effect. You may cancel your subscription before the new price applies and will not be charged the increased rate.
5. Data Accuracy Disclaimer
Scratch IQ provides analytics based on publicly available data from state lotteries. We do not guarantee that the data displayed is complete, current, or error-free. State lotteries update their prize data periodically, and there may be a lag between when prizes are claimed and when the data is reflected on our platform. The underlying prize data is sourced from publicly available information published by state lottery commissions. Scratch IQ does not control, verify, or guarantee the accuracy of data published by state lotteries.
The Expected Value calculations, status ratings, and other analytics provided by the Service are for informational purposes only and should not be interpreted as financial advice or a guarantee of returns. All lottery games carry inherent risk, and past performance does not predict future outcomes. Users should independently verify any information before making purchasing decisions.
6. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, design, analytics methodologies, and software — are the exclusive property of Scratch IQ and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without prior written permission.
7. Prohibited Use
- Using the Service for any unlawful purpose
- Scraping, crawling, or automated data collection from the Service
- Attempting to gain unauthorized access to any part of the Service
- Interfering with or disrupting the Service or its infrastructure
- Reselling, redistributing, or commercially exploiting Service data
- Creating competing products using data obtained from the Service
8. Limitation of Liability
To the fullest extent permitted by law, Scratch IQ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to financial losses from lottery ticket purchases made based on information provided by the Service.
In no event shall Scratch IQ's total aggregate liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the total amount you paid to Scratch IQ in the twelve (12) months preceding the claim, or (b) fifty dollars ($50.00 USD).
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
If the Service is materially unavailable for more than seventy-two (72) consecutive hours, you may request a pro-rata credit for the affected period by contacting support@scratchiq.io.
9. Indemnification
You agree to indemnify, defend, and hold harmless Scratch IQ and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We reserve the right to suspend or terminate your account and access to the Service for conduct that we determine violates these Terms, involves fraud or illegal activity, or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.
If we terminate your paid account for reasons other than fraud, illegal activity, or material breach of these Terms, we will provide a pro-rata refund for any unused portion of your current billing period.
11. Force Majeure
Scratch IQ shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to changes to state lottery data sources, third-party service outages, internet disruptions, natural disasters, or government actions.
12. Dispute Resolution & Arbitration
Informal Resolution. Before initiating any formal dispute proceeding, you agree to first contact us at support@scratchiq.io and attempt to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration. If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Florida, or at your election, may be conducted by phone or videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. YOU AND SCRATCH IQ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Small Claims Exception. Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to support@scratchiq.io within thirty (30) days of first accepting these Terms. If you opt out, the Governing Law and forum selection provisions shall apply.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved in the courts of the State of Florida.
14. Third-Party Services
The Service may contain links to third-party websites, resources, or services. Scratch IQ does not endorse and is not responsible for the content, accuracy, or practices of any third-party sites. Your use of third-party sites is at your own risk and subject to those sites' own terms and privacy policies.
15. General Provisions
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scratch IQ regarding the Service and supersede all prior agreements, representations, and understandings.
No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
